REGULAMIN REZERWACJI I KORZYSTANIA Z APARTAMENTÓW – STAYFIRST

§ 1. Postanowienia ogólne

§ 2. Rezerwacja, płatności i faktury VAT

§ 4. Zameldowanie i środki dostępu

5. Opłaty, o których mowa w ust. 4, pokrywają koszty techniczne odtworzenia elementu i dezaktywacji zabezpieczeń.

§ 7. Monitoring i systemy bezpieczeństwa

§ 8. Interwencja i natychmiastowe rozwiązanie umowy

1. W przypadku stwierdzenia naruszeń postanowień niniejszego Regulaminu (w szczególności zakazu organizowania imprez, przekraczania norm hałasu lub liczby osób), StayFirst lub powołana służba ochrony mają prawo podjąć interwencję.

2. Stwierdzenie podczas kontroli (lub wskutek odmowy jej przeprowadzenia) naruszeń Regulaminu, w szczególności organizowania imprezy, przekroczenia liczby osób, palenia wyrobów tytoniowych lub zakłócania spokoju, stanowi podstawę do rozwiązania umowy najmu ze skutkiem natychmiastowym z winy Gościa.

§ 9. Szkody i sprzątanie dodatkowe

2. StayFirst zastrzega sobie prawo do pobrania kaucji (depozytu zabezpieczającego) na poczet ewentualnych zniszczeń w wysokości do 1000 zł.

§ 10. Siła wyższa i przerwy w dostawie mediów

3. W sprawach nieuregulowanych niniejszym Regulaminem zastosowanie mają odpowiednie przepisy powszechnie obowiązującego prawa polskiego.

RULES FOR RESERVING AND USING APARTMENTS – STAYFIRST

§ 1. General Provisions

1. These Terms and Conditions set forth the rules for making reservations, checking in, using, and checking out of apartments managed by StayFirst sp. z o.o., with its registered office in Warsaw at ul. Złota 75A/7, 00-819 Warsaw, Tax ID (NIP): 5273169019 (hereinafter: “StayFirst”).

2. Making a reservation constitutes acknowledgment and acceptance of the provisions of these Terms and Conditions by the person making the reservation (hereinafter: “Guest”).

3. StayFirst acts as an operator managing short-term rentals on behalf of the property owner or pursuant to a legal authorization.

4. These Terms and Conditions apply to all persons staying in the apartment as part of a given reservation, including guests.

5. The Guest making the reservation bears full responsibility for ensuring that all persons to whom they have granted access to the apartment comply with these Terms and Conditions.

§ 2. Reservations, Payments, and VAT Invoices

1. Reservations may be made: a) through external booking platforms (e.g., Booking.com, Airbnb); b) directly with StayFirst—by phone, email, or through the official website; c) through the Hotres online booking system.

2. The reservation is confirmed upon payment of the total fee for the stay or the required deposit—in accordance with the terms of the selected offer—and upon the Guest’s receipt of an electronic reservation confirmation.

3. The minimum age of the person making the reservation is 18 years. StayFirst reserves the right to request presentation of an identification document to verify age.

4. The amount due for the stay depends on the selected dates, the number of guests, the apartment’s standard, and the offer’s pricing terms.

5. If a VAT invoice is requested for a business entity (company), the Guest is required to notify StayFirst of this fact and provide complete details (including the tax identification number) no later than at the time of making the reservation or paying for the stay. Converting a fiscal receipt into an invoice for a business entity at a later date may not be possible due to applicable tax regulations.

§ 3. Cancellation of Reservations

1. The rules and costs associated with canceling a reservation are governed by the terms of the offer selected by the Guest (flexible or non-refundable rate).

2. Failure to arrive on the scheduled date (no-show) or voluntary shortening of the stay by the Guest does not constitute grounds for a refund of fees paid for the unused period, unless the terms of the offer state otherwise.

3. In the event of a reservation cancellation due to reasons attributable to StayFirst, the operator is obligated to offer an alternative accommodation of a standard no lower than that of the reserved unit or—if this is not possible—to refund the full amount paid.

§ 4. Check-in and Access

1. Check-in for the apartment is conducted remotely via a dedicated online system provided by StayFirst. The Guest is required to provide accurate information, accept the Terms and Conditions, and undergo any necessary identity verification.

2. Entry instructions and individual access codes are provided once the booking conditions have been met, including full payment and completion of the online check-in process.

3. Keys, cards, access tokens, remote controls, and access codes are entrusted to the Guest solely for the duration of their stay. It is prohibited to share them with third parties not included in the reservation.

4. In the event of loss, damage, or failure to return an access device, the Guest will be charged a compensation and service fee in the amount of: a) 300 PLN for a traditional physical key; b) 100 PLN for a contactless tag, card, or remote control.

5. The fees referred to in paragraph 4 cover the technical costs of replacing the item and deactivating the security measures. If it becomes necessary to replace the lock cylinders in the doors or the entire access control system due to gross negligence on the part of the Guest, StayFirst has the right to seek full compensation corresponding to the actual costs incurred by the operator.

6. The Guest is required to immediately report the loss of control over the access device (e.g., loss of a phone with the mobile app or keys).

§ 5. Rules for Staying in the Apartment

1. The stay begins at 4:00 p.m. on the check-in date and ends at 11:00 a.m. on the check-out date. Early check-in or late check-out requires prior arrangement with StayFirst and is subject to the apartment’s current availability.

2. Strict quiet hours must be observed in the apartments and buildings from 10:00 p.m. to 6:00 a.m. During this time, loud behavior, playing music, and any activities that disturb the peace of neighbors are prohibited.

3. It is strictly prohibited to organize parties, bachelor parties, bachelorette parties, or social gatherings of any kind in the apartments.

4. The number of people staying in the apartment may not exceed the number of guests listed in the reservation.

5. Pets are permitted only in designated areas, following prior notification and payment of the applicable fee. Bringing a pet into the property without the operator’s consent will result in the imposition of the standard fee plus an additional compensation fee of 300 PLN.

6. Smoking of tobacco products, e-cigarettes, and related products is strictly prohibited in the apartments, on balconies, on terraces, and in the building’s common areas. Violation of this prohibition will result in a compensation fee of 1,000 PLN to cover the cost of specialized ozone treatment and cleaning of the premises.

7. Guests are required to use electrical appliances and household appliances safely. It is prohibited to leave heating appliances (stoves, ovens, irons) turned on and unattended, or to leave the apartment in a manner that poses a fire hazard.

§ 6. Guest Liability for Third Parties

1. The guest making the reservation bears full financial and legal responsibility for any actions, omissions, or conduct of third parties whom they have brought into the apartment or to whom they have granted access to the premises, regardless of whether such persons were included in the reservation request.

§ 7. Surveillance and Security Systems

1. To protect property and ensure the safety of persons on the premises, video surveillance systems (recording footage exclusively outside the premises) may be in operation in common areas and in front of apartment entrances.

2. Non-intrusive noise level sensors (which measure only sound intensity without recording the content of conversations) and smoke detectors may be installed in the apartments. Triggering a fire alarm due to a violation of the no-smoking policy or improper use of equipment will result in emergency service response costs, which will be charged to the Guest.

3. The activation of a smoke detector or exceeding the permissible decibel (noise) level constitutes a valid basis for an urgent inspection of the apartment’s condition by an authorized StayFirst employee or security personnel.

4. The Guest is required to allow a StayFirst employee into the apartment and permit them to conduct an inspection in the situations described in paragraph 3.

5. In the event of a refusal to admit an employee, failure to contact the Guest, or obstruction of the inspection, a StayFirst employee is authorized to enter the apartment using a spare key or emergency code in order to check the condition of the premises, eliminate any hazard, or verify violations of these Terms and Conditions.

§ 8. Intervention and Immediate Termination of the Agreement

1. In the event of violations of the provisions of these Terms and Conditions (in particular, the prohibition on hosting parties, exceeding noise limits, or exceeding the maximum number of occupants), StayFirst or the appointed security service has the right to intervene.

2. The discovery during an inspection (or as a result of a refusal to allow an inspection) of violations of these Rules and Regulations—in particular, hosting a party, exceeding the occupancy limit, smoking tobacco products, or disturbing the peace—constitutes grounds for immediate termination of the lease agreement due to the Guest’s fault.

3. In the event of immediate termination of the agreement, the Guest and any persons staying with them are required to leave the apartment immediately upon request by a StayFirst employee or security personnel. In such a case, the payment made for the stay is non-refundable.

§ 9. Damage and Additional Cleaning

1. The Guest bears full financial responsibility for any damage, destruction, or loss of furnishings in the apartment and the building caused by the Guest or persons staying with the Guest.

2. StayFirst reserves the right to collect a security deposit of up to 1,000 PLN to cover any potential damage.

3. If, after the Guest’s departure, soiling is found that exceeds the scope of standard cleaning (e.g., difficult stains on upholstery, mattresses, or carpets), the guest will be charged the actual costs of specialized cleaning (e.g., upholstery cleaning—starting at 200 PLN, removal of stubborn stains—starting at 300 PLN).

4. The guest is required to report any defects or damage found in the apartment immediately upon check-in, either by email or through the reservation system.

§ 10. Force Majeure and Interruptions in Utility Service

1. StayFirst shall not be liable for non-performance or improper performance of services if such failure is caused by circumstances constituting force majeure (including natural disasters, decisions by government authorities, and strikes).

2. StayFirst shall not be liable for interruptions in the supply of utilities (electricity, water, gas, heating, internet) resulting from failures in external transmission networks or the actions of municipal or external suppliers. Such interruptions do not constitute grounds for claims for damages against the operator.

§ 11. Items Left in the Apartment

1. Personal items left by the Guest in the apartment after the end of the stay will be stored for a period of 30 days, after which they will be disposed of.

2. The shipment or return of items left behind shall take place at the Guest’s express request and expense, in a manner agreed upon with StayFirst.

§ 12. Complaints

1. Any complaints regarding the quality of services provided must be submitted electronically to the email address: kontakt@stayfirst.pl, preferably during the stay, to allow for a prompt response and resolution of the issue.

2. Submitted complaints are reviewed by StayFirst within 14 business days of receipt.

§ 13. Final Provisions

1. StayFirst reserves the right to refuse check-in or to hand over keys to any person who is visibly under the influence of alcohol or intoxicating substances, or who behaves aggressively.

2. Guests are required to comply with the general rules and regulations in effect in the residential building where the apartment is located.

3. In matters not covered by these Terms and Conditions, the relevant provisions of generally applicable Polish law shall apply.
